1. About Hemasseur

Hemasseur is an online directory and membership platform that enables independent massage professionals and service providers to create profiles, advertise services, communicate with prospective clients, and maintain professional listings.

Hemasseur is solely a technology platform and advertising service. Hemasseur does not provide massage services, wellness services, healthcare services, or any other services advertised by users of the Platform.

All services offered through listings are provided solely by independent users and not by Hemasseur.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age.
  • Have the legal capacity to enter into a binding contract.
  • Provide truthful and accurate information.
  • Not be prohibited from using the Platform under applicable law.

By using the Platform, you represent and warrant that you meet these requirements.

3. User Accounts

Certain features require account registration.

You agree that:

  • Information you provide is accurate and current.
  • You will maintain the confidentiality of your credentials.
  • You are responsible for all activity occurring under your account.

Membership fees:

  • Automatically renew unless canceled.
  • Are subject to applicable taxes.
  • Are non-refundable except where required by law or expressly stated otherwise.

Users are responsible for reviewing current pricing before purchasing or renewing a membership.

5. Verification Program

Hemasseur may require verification before a profile becomes publicly visible.

Verification may include:

  • Identity verification
  • Government-issued identification
  • Contact verification
  • Photo verification
  • Business verification
  • Additional supporting documentation

Verification helps maintain platform integrity but does not constitute an endorsement, certification, guarantee, or warranty of any user.

Hemasseur reserves the right to approve, deny, revoke, or repeat verification requirements at its sole discretion.

6. Independent Providers

All professionals, advertisers, and service providers listed on Hemasseur are independent businesses or individuals.

Hemasseur:

  • Does not employ providers.
  • Does not supervise services.
  • Does not control pricing.
  • Does not schedule appointments.
  • Does not guarantee qualifications.
  • Does not guarantee availability.
  • Does not guarantee service quality.

Any agreement formed between users occurs exclusively between those users. Hemasseur is not a party to those agreements.

7. User Conduct

You agree not to:

  • Violate any law or regulation.
  • Publish false or misleading information.
  • Impersonate another person.
  • Harass, threaten, abuse, or intimidate others.
  • Upload malicious software.
  • Attempt unauthorized access to the Platform.
  • Interfere with Platform operations.
  • Circumvent security features.
  • Use automated tools to scrape, harvest, or copy Platform data.
  • Create fake accounts.
  • Engage in fraudulent activity.

We reserve the right to investigate violations and take any action we deem appropriate.

8. Prohibited Content

Users may not publish content that:

  • Is unlawful.
  • Is defamatory.
  • Is fraudulent.
  • Is misleading.
  • Infringes intellectual property rights.
  • Contains malware or harmful code.

9. User Content License

This license continues for as long as the content remains on the Platform and for a reasonable period thereafter as necessary for business operations.

10. Reviews and Ratings

Users may submit reviews and ratings.

Reviews must:

  • Reflect genuine experiences.
  • Be truthful.
  • Not contain harassment or defamatory statements.

Hemasseur reserves the right to remove reviews at its sole discretion. We are under no obligation to verify the accuracy of reviews.

11. Payments

Payment processing may be performed by third-party payment providers.

Hemasseur does not store complete payment card information.

You authorize recurring billing for any subscription or membership purchased until canceled.

Failure to pay may result in suspension or termination of your account or listing.

12. Intellectual Property

The Platform and all associated content, including software, design, logos, graphics, databases, text, trademarks, and branding, are owned by Hemasseur or its licensors and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse engineer, or exploit Platform content without written permission.

13. Copyright Complaints

If you believe content infringes your copyright, you may submit a notice including:

  • Identification of copyrighted material.
  • Identification of the allegedly infringing content.
  • Your contact information.
  • A statement made under penalty of perjury that your claim is accurate.

Hemasseur may remove allegedly infringing content while investigating.

14. Third-Party Links

The Platform may contain links to third-party websites and services.

Hemasseur does not control and is not responsible for third-party content, privacy practices, security practices, or products and services.

Accessing third-party websites is at your own risk.

15. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEMASSEUR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED, THAT LISTINGS ARE ACCURATE, THAT USERS ARE TRUTHFUL, OR THAT SERVICES WILL MEET EXPECTATIONS.

16. Assumption of Risk

Users assume all risks arising from contacting providers, scheduling appointments, visiting locations, inviting providers to locations, relying on profile information, and interacting with other users.

Users are solely responsible for conducting their own due diligence.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEMASSEUR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL DAMAGES, LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR PERSONAL INJURIES ARISING FROM USER INTERACTIONS.

IN NO EVENT SHALL HEMASSEUR'S TOTAL LIABILITY EXCEED THE GREATER OF $100 USD OR THE TOTAL FEES PAID BY YOU TO HEMASSEUR DURING THE PREVIOUS TWELVE MONTHS.

18. Indemnification

You agree to defend, indemnify, and hold harmless Hemasseur and its officers, directors, employees, contractors, affiliates, and agents from claims, damages, liabilities, losses, and expenses arising from your use of the Platform, your content, your violation of these Terms, your violation of applicable law, or your interactions with other users.

19. Account Suspension and Termination

Hemasseur may suspend, restrict, or terminate any account at any time if these Terms are violated, fraud is suspected, false information is provided, illegal activity is suspected, or platform security is threatened.

Termination may occur without prior notice.

20. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Florida, United States, without regard to conflict-of-law principles.

21. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).

Users waive any right to participate in class actions, class arbitrations, or representative proceedings.

Nothing in this section prevents either party from seeking temporary injunctive relief where appropriate.

22. Changes to These Terms

Hemasseur may update these Terms at any time. Updated versions become effective upon posting. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
